TERMS AND CONDITIONS 

Introduction

These Terms and Conditions (“Terms”) govern the provision of insurance services by NSIA Insurance Limited to policyholders. 

By accessing or using our website, mobile app, purchasing, renewing, or using any insurance policy issued by us, you agree to be bound by these Terms. If you do not agree, do not use the online platforms. 

 

Scope of Services

Our Online Platforms allow users to obtain quotations, purchase, renew, and manage insurance policies, as well as initiate and track claims. Each insurance policy is governed by the specific Policy Document issued for that product. In the event of a conflict between these Terms and the Policy Document, the latter shall prevail. 

Eligibility

To obtain insurance coverage: 

  • You must be at least 18 years old and have full legal capacity to enter into binding contracts under Nigerian law. 
  • You must provide accurate and complete information. 
  • You must meet the eligibility requirements stated in the policy. 
  • The Company reserves the right to accept or reject applications at its discretion. 

 

Payment andPolicy Coverage 

  • All premiums must be paid in full before cover is incepted and becomes effective, in compliance with Section 60 (1) of the Nigerian Insurance Industry Reform Act (NIIRA), 2025   
  • Failure to pay premiums may result in suspension or cancellation of coverage and if payments fails or reverse, any provisional insurance cover shall be void.  
  • Premiums paid are generally non-refundable except where required by law or approved by the Company. 

The Company may: 

  • Adjust premiums upon renewal; 
  • Introduce revised pricing subject to regulatory approval where applicable. 

5. Duty of Disclosure

You agree to disclose all material facts relevant to the insurance application. 

Failure to disclose accurate information may result in: 

  • Claim denial; 
  • Policy cancellation; 
  • Legal action where fraud is established. 

6.Exclusions

The policy shall not cover: 

  • Fraudulent acts; 
  • Intentional or criminal acts by the insured; 
  • War, terrorism, riots, or civil unrest unless expressly covered; 
  • Pre-existing conditions were excluded; 
  • Events specifically excluded in the policy schedule. 
  • Additional exclusions may apply depending on the insurance product. 

7.Limitation of Liability

Our Online Platforms and their content are provided “as is” and “as available.” NSIA shall not be liable for losses arising from: 

  • Internet or system interruptions 
  • Errors or delays caused by third-party service providers 
  • Inaccurate user data submissions 

8.Fraud and Misrepresentation

Any fraud, attempted fraud, false declaration, or material misrepresentation may result in immediate policy termination, claim forfeiture, reporting to regulatory or law enforcement authorities, etc. 

9. Data Protection and Privacy

The Company processes personal information in accordance with the Nigeria Data Protection Act (NDPA) 2023, General Application and Implementation Directive (GAID) 2025 and our Privacy Policy. By using our services, you consent to the collection, storage, and processing of your information for: 

  • Underwriting; 
  • Claims administration; 
  • Regulatory compliance; 
  • Fraud prevention. 

Intellectual Property

All content, logos, and materials on our Online Platforms are the property of NSIA Insurance Ltd. You may not copy, distribute, or modify any part without prior written consent.  

Cancellation and Termination

The policy may be cancelled: 

  • By the policyholder upon written notice; 
  • By the Company for non-payment, fraud, misrepresentation, or breach of terms. 

Where cancellation occurs: 

  • Coverage ceases from the effective cancellation date; 
  • Refunds, if any, shall be calculated according to Company policy and applicable law. 

Renewal

  • Policies may be renewed subject to: 
  • Payment of renewal premium; 
  • Updated underwriting assessment; 
  • Compliance with revised terms. 

The Company is not obligated to renew any policy. 

13.Governing Lawand Dispute Resolution 

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through arbitration in Lagos in accordance with the Arbitration and Mediation Act, 2023, and the decision shall be final and binding. 

14. Amendments

The Company reserves the right to amend these Terms from time to time. Updated Terms shall become effective upon publication on the Company’s official platforms or sent via email. Continued use after updates constitutes acceptance of the revised Terms.
